Do I have a Wrongful Death Case?

There are many factors that attorneys look at when determining whether you have a wrongful death case. Some of the factors are;(1) who is at fault for the wrongful death; (2) who are the surviving heirs; (3) any insurance policies that may cover the loss; (4) witnesses to the accident or circumstances surrounding the wrongful death; and (5) the cause of death. Other factors attorney's look at are the nature and extent of your communications with the insurance company before you have retained an attorney.

Insurance companies look at the above factors, along with many other factors.

Insurance companies know one thing to be true; if a party a wrongful death presents a claim to them, and is not represented by an attorney, "they have a sucker on their hands." They know that in the vast majority of cases where a wrongful death heir is not represented by a lawyer, that the person will not know what their legal rights are, or what they are legally entitled to collect in for the wrongful death case.

In these types of situations where you present a claim to insurance company without legal representation, you will most often be presented with a lowball settlement offer, or no settlement offer at all.
